Terms of Service

These Terms are the agreement between you and Alano Tech Pte. Ltd. governing your use of OmuType, a Cantonese-first keyboard for typing and voice. OmuType is a sister product of Omucloud, made by the same company. By installing or using OmuType you accept these Terms.

Summary (for orientation only; the numbered sections are the operative terms):

OmuType is free. There are no purchases in the app today.

Voice features use AI. Their results can be wrong, so read what the keyboard has written before you send it.

Use it lawfully. Section 6 lists what is not allowed.

The agreement is governed by Singapore law. Nothing in it removes a right the law gives you as a consumer.

Because the service is free, our liability is limited. Section 11 sets out the limits.

1. Who you are contracting with

OmuType is operated by Alano Tech Pte. Ltd. (UEN 202555886D), a company incorporated in Singapore, registered office 60 Paya Lebar Road, #06-28, Singapore 409051. In these Terms "we", "us" and "our" mean that company, and "you" means the person using OmuType.

How we handle personal data is set out in our Privacy Policy, which forms part of this agreement.

2. Who may use it

You must be at least 13 years old to use OmuType. If you are under 18, or under the age of majority where you live, you may use it only with the permission of a parent or guardian, who accepts these Terms for you. You must not use OmuType if you are barred from doing so under any law that applies to you, including sanctions law.

3. What OmuType does, and your licence to use it

OmuType is an on-screen keyboard. It turns keys into Cantonese and English words on your device (Jyutping, Cangjie, Quick and English), and it offers voice features: dictation, and spoken instructions such as editing, shortening, rewriting, translating or sending a message. Typing works without a network connection. Voice features need the network and the microphone permission.

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use OmuType on devices you own or control, for your own use, in accordance with these Terms and the rules of the store you obtained it from.

4. It is free

OmuType is currently free of charge. There are no in-app purchases or subscriptions, and we never ask for payment details. We may set fair-use limits on the voice features, which cost us money to provide, and may apply them per install.

If we ever introduce paid features, we will describe them and their price before you can buy them, you will be charged only if you choose to buy, and nothing that is free for you when you start using OmuType will be withdrawn without at least 30 days' notice in the app.

5. AI results: check before you send

Speech recognition and AI are imperfect. OmuType may mishear you, spell a name wrongly, treat an instruction as words to insert or words as an instruction, change more or less than you meant, or translate or rewrite inaccurately. It may occasionally produce text you did not say.

  • You are responsible for reviewing the text in a field before you send, post or submit it. OmuType shows what it changed and lets you undo it for that reason.
  • When you ask OmuType by voice to send a message, it asks you to confirm first. The decision to send is yours.
  • Do not rely on OmuType where a mistake could cause serious harm, such as for medical, legal or financial instructions or emergency communications, without checking the text yourself.

AI results are provided as they are. We do not promise that they are accurate, complete or suitable for any purpose, and to the extent the law allows, we are not responsible for what you send after you have had the chance to review it.

6. Your undertaking to use it lawfully

You agree that you will not use OmuType, or permit it to be used:

  • for any unlawful purpose, including fraud, harassment, threats or impersonation;
  • to record or transcribe another person's speech without the consent the law where you are requires;
  • to reverse engineer, decompile or modify the app, except as far as the law expressly allows despite this restriction;
  • to access or call our servers or our providers other than through the app as we supply it, to extract our access codes, to scrape or overload the service, or to get around usage limits; or
  • to resell, sublicense or offer the voice features as a service to others.

If you use OmuType in breach of this section, or in a way that threatens the service or other users, we may block the voice features for your install without notice.

7. Your content is yours

What you type, what you say and your keywords remain yours. We claim no ownership of them and no right to use them beyond what is needed to provide the voice features to you at that moment, as described in the Privacy Policy. Nothing in these Terms gives us a licence to publish your content, use it in marketing, or train any model on it.

8. Third-party services

Voice features rely on speech-recognition and AI providers, named in section 6 of the Privacy Policy, and the app runs on your device's operating system and is distributed through app stores. We are not responsible for those third parties' services or their availability, but we remain responsible to you for how we use them to provide OmuType.

OmuType includes data licensed from others, including Cantonese dictionary data from rime-cantonese (CC BY 4.0), English word frequencies from FrequencyWords (CC BY-SA 4.0), Chinese conversion tables from OpenCC (Apache 2.0), Cangjie codes from the Unicode Unihan database (Unicode License), and the IBM Plex typeface (SIL Open Font License). Those parts are governed by their own licences, which are listed in the app.

9. Our intellectual property

Apart from the third-party material in section 8, OmuType, including its software, design, name and logo, belongs to us or our licensors. These Terms give you a licence to use it, not ownership of it, and no right to use our name or logo.

Suggestions and feedback you send us may be used freely to improve OmuType, without obligation to you. Report suspected security issues to security@omucloud.co.

10. Early release, availability and changes

OmuType is new and is still being developed. Features may change, be added or be removed, and the voice features depend on the network and on providers we do not control. We do not promise the service will be uninterrupted or error-free.

You may stop using OmuType at any time by switching to another keyboard or uninstalling it. We may withdraw OmuType or its voice features; if we do, we will give at least 30 days' notice in the app where we reasonably can. Typing, which runs on your device, will keep working in the version you have installed.

11. Our responsibility to you

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Your rights under the Consumer Protection (Fair Trading) Act 2003 and any other consumer-protection law that applies to you are not affected.

Basis of these limitations

OmuType is provided free of charge; we receive nothing from you for it. Typing runs on your own device, and voice results are shown to you before you send anything, with an undo. On that basis you and we agree the limits below are reasonable.

Loss we are not liable for

  • loss of profit, revenue, business, goodwill or reputation;
  • any indirect or consequential loss;
  • loss caused by text you sent without reviewing it, as section 5 asks; or
  • the acts or omissions of third parties, including app stores, your device's operating system and the apps you type into.

Aggregate limit

Subject to the first paragraph of this section, our total liability to you for all claims connected with OmuType, whether in contract, in tort (including negligence), for breach of statutory duty or otherwise, is limited to S$100.

Time limit for claims

Any claim must be brought within 12 months of the date you became aware, or ought reasonably to have become aware, of the circumstances giving rise to it.

Each limitation stands alone

Each exclusion and limitation in this section is separate. If a court finds any of them unenforceable, the rest continue to apply to the fullest extent permitted.

12. Changes to these Terms

We may change these Terms. If a change materially affects your rights or obligations, we will tell you in the app at least 30 days before it takes effect. We do not treat continued use as acceptance of a material change: if you do not accept it, you may stop using OmuType, and the change will not apply to you retrospectively.

13. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, including non-contractual claims, are governed by the laws of Singapore.

You and we submit to the non-exclusive jurisdiction of the courts of Singapore. Nothing in this section affects any right you have as a consumer to bring proceedings in the courts of the place where you live, including Hong Kong, or to rely on the mandatory consumer-protection law of that place.

14. General

If any provision of these Terms is found unenforceable, the rest continues in force. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a company that takes over OmuType, provided your rights are not reduced. These Terms and the Privacy Policy are the whole agreement between us about OmuType, but that does not exclude liability for anything we said dishonestly.

15. Additional terms for app stores

Google Play

If you obtained OmuType from Google Play, the Google Play Terms of Service also apply to your use of the store. These Terms are between you and us, not Google.

Apple App Store

This part applies when you use OmuType obtained from the Apple App Store, and takes precedence over any conflicting term above for that use.

  • Acknowledgement. These Terms are between you and Alano Tech Pte. Ltd. only, not with Apple. Alano Tech Pte. Ltd., not Apple, is solely responsible for the app and its content.
  • Scope of licence. You are granted a non-transferable licence to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Maintenance and support. Alano Tech Pte. Ltd. is solely responsible for any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
  • Warranty. Alano Tech Pte. Ltd. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Product claims. Alano Tech Pte. Ltd., not Apple, is responsible for addressing any claims relating to the app or your use of it, including product liability claims, any claim that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  • Intellectual property. In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, Alano Tech Pte. Ltd., not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer name and address. Questions, complaints and claims relating to the app should be directed to Alano Tech Pte. Ltd., 60 Paya Lebar Road, #06-28, Singapore 409051, at info@omucloud.co.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using the app.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
